In March of 2020, under the pretense of public health, the Trump Administration used the CDC’s Title 42 for the first time ever as its basis for immigration policy.

The previous administration claimed the concerns of Title 42 superseded all other US immigration laws, including those that protect migrants’ rights to seek asylum, and thus hundreds of thousands of vulnerable migrant children and their families have been expelled from our borders, without due process, over the last year under the guise of public health.

Use of this policy has quietly continued under the Biden Administration, resulting in thousands of more families being denied an opportunity to seek asylum and putting untold amounts of children and families in harm’s way, like our client Ellie.

Following their expulsion to Mexico under Title 42, Ellie and her mom were kidnapped and only just managed to escape. After this traumatizing experience and worried she could not keep her daughter safe in the border city where asylum seekers are often preyed upon, kidnapped, and worse, Ellie’s mother sent her daughter over the border alone. 

Instead of being allowed to seek asylum with her mother, Ellie became an unaccompanied minor and had to endure the trauma of immigration detention—as thousands of other children have, as thousands more will if the government continues use of this cruel policy.

Title 42 hurts families like Ellie’s—and it doesn’t protect public health interests. Public health experts, including top CDC officials, have repeatedly confirmed that invoking public health concerns to turn away asylum seekers and expel unaccompanied minors, many of whom are fleeing incredible traumas and violence, has no justifiable scientific basis.
